Data protection information for applications via Facebook Lead Ads

Thank you for your interest in our company. In accordance with the provisions of Art. 13 of the General Data Protection Regulation (GDPR), we hereby inform you about the processing of your personal data transmitted in the frame of the application process as well as any personal data collected by us and your rights in this regard.

II Purposes and legal bases of this processing

We process your data in compliance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). The primary purpose of data processing is to contact you to initiate an application process. The processing of your contact data is based on your consent. The primary legal basis for this is Art. 6 para. 1 lit. a) GDPR.

III Categories of personal data

The processed categories of your personal data include in particular your master data (name, telephone number, e-mail address), as well as professional experience and qualifications.

As a rule, your personal data is collected directly from you in the frame of the contact via the lead ads on Facebook. In the frame of the lead ads, you provide the personal data that is required to make contact. Without this data, we will not be able to contact you and make a decision on whether to initiate an application process.

IV. Recipients of the data

Within our company, only those persons and departments (e.g. specialist department) will receive your personal data that need it to make the decision to contact you and to fulfill our pre-contractual, contractual and legal obligations.

As the lead ad campaign is carried out via Facebook, we expressly point out the joint responsibility with Facebook. Therefore, we cannot assess who the recipients on this page are. Due to the joint responsibility with Facebook, we expressly refer to Facebook's data protection notice:

V. Processor

As part of order processing in accordance with Art. 28 GDPR, we pass on your data to service providers who support us in the application campaign and the associated processes. These service providers act strictly in accordance with our instructions and are contractually obliged to do so.

In the following, we name the processors with whom we cooperate if we have not already done so in the previous section of the privacy policy. If data is transferred outside the European Union (EU) or the European Economic Area (EEA) in this context, we will inform you about the appropriate level of data protection.

VI Duration of data storage

The storage of your personal data by Hengst SE is carried out in compliance with legal requirements regarding retention and documentation obligations. In compliance with the statutory provisions, Hengst SE will store the personal data you provide in the frame of your application for a period of up to 180 days after the end of your application process.

Longer storage may also take place if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.

As the lead ad campaign is carried out via Facebook, we would like to point out once again that we are jointly responsible with the provider. Therefore, we cannot assess how long your transmitted data will be stored there.

VII Automated decisions in individual cases including profiling

In the frame of application procedures, we do not use automated decision-making including profiling in accordance with Art. 22 GDPR.

VIII. Your rights

Under the GDPR, you have the right to information, rectification, erasure, restriction of processing and data portability as well as the right to withdraw your consent. You can also withdraw your consent at any time and without reason in order to prevent the processing of your personal data that was collected and processed on the basis of a declaration of consent. IX. Status and updating of the data protection information

The current status of this privacy policy is August 2023. We reserve the right to adapt the data protection information at regular intervals to the underlying data processing processes or due to changes in the legal situation.
